QUESTION: I am a union member. Can my employer force me to be vaccinated?
ANSWER: It is best to contact your union representative. However, you are covered by a collective bargaining
agreement. If that does not cover mandatory vaccinations, then the
employer requiring vaccination is a change in your conditions of
employment. The COVID vaccines are unlike most other vaccinations;
the FDA has given "emergency use authorization" and that is probably
not covered in your CBA.
Some NYS agencies have quietly worked out agreements with unions to
avoid job actions and lawsuits. Your union reps are probably already
bargaining with your employer to resolve the vaccination mandate. You
may also have rights under federal law if you object
to vaccination on medical or religious reasons. Again, contact your union rep. And good luck.
