The U.S. Department of Justice on Friday appealed a federal judge's Jan. 8 opinion and order stating John Sarcone III is unlawfully serving in his position as acting U.S. attorney overseeing the Northern District of New York.

The move also appeals the quashing of Sarcone's August subpoenas against state Attorney General Letitia James' office, seeking records about civil cases brought against President Donald Trump and the National Rifle Association.

An additional motion asks the District Court judge to stay the ruling pending appeal. MORE AT Dept. of Justice appeals district court's ruling on Sarcone
