THE 9/17 BOARD OF ED WORK SESSION

Not surprisingly, the school board went into executive session at the 9/17 WORK SESSION/meeting, presumably to discuss the litigation. PDE/DEFENDNG EDUCATION has expectedly filed with Judge Seibel. Will post if the school publicly responds but as with all litigation matters, will also expect them to say little.

FYI:  Via Google AI ---a "mini en banc" panel of the U.S. Court of Appeals for the Second Circuit officially reversed the district court's dismissal on September 15, 2026. The case, Defending Education v. Croton-Harmon Union Free School District, was remanded back down to the U.S. District Court for the Southern District of New York (where it was originally overseen by Judge Cathy Seibel). The landmark decision threw out a 53-year-old circuit precedent (Aguayo v. Richardson). It ruled that membership organizations like Defending Education (formerly Parents Defending Education) do have "associational standing" to bring constitutional § 1983 claims on behalf of their anonymous members.
