BREAKING NEWS, FEDERAL JUDGE STRIKES DOWN BIDEN'S TRAVEL MASK MANDATE -- UNLAWFUL

A United States District Court judge in Florida vacated the nationwide travel mask mandate on Monday in a ruling that found the mask requirement for travel via mass transit, planes, and trains violated the Administrative Procedure Act (APA). The lengthy ruling explains how the Biden administration "improperly invoked the order and interpretive rule exceptions to notice and comment," "improperly invoked the good cause exception" to such rulemaking in a manner that "was not harmless error" and how the mandate "is arbitrary and capricious because the CDC failed to adequately explain its reasoning."  MORE AT TOWNHALL https://townhall.com/tipsheet/spencerbrown/2022/04/18/federal-judge-strikes-down-bidens-travel-mask-mandate-n2606014?utm_source=breakingemail

Federal judge vacates CDC mask mandate in airports, other transport hubs

A federal judge in Florida voided the Centers for Disease Control and Prevention’s mask mandate for airports, planes and other forms of travel Monday, saying the agency overstepped its authority.

US District Judge Kathryn Kimball Mizelle, an appointee of President Donald Trump, ruled that the CDC did not properly explain its decision last week to extend the mandate for another 15 days after it was originally set to expire Monday. https://nypost.com/2022/04/18/florida-federal-judge-strikes-down-cdc-airport-mask-mandate/

  1. Can this be appealed? I don't take any mass transit or fly while masks are required.

  2. Well according to THE HILL, the TSA isn't enforcing the masks anymore: The Transportation Security Administration (TSA) is no longer enforcing the federal government’s mask mandate for travel after a federal judge in Florida struck down the Centers for Disease Control and Prevention’s (CDC) directive.

“The agencies are reviewing the decision and assessing potential next steps,” a Biden administration official said. “In the meantime, today’s court decision means CDC’s public transportation masking order is not in effect at this time.”

“Therefore, TSA will not enforce its Security Directives and Emergency Amendment requiring mask use on public transportation and transportation hubs at this time,” the official said.
