To the Editor:

Trustee Ann Gallelli’s letter in the Gazette last week was a marvel of pretense.  What Ms. Gallelli says in her letter is not technically incorrect.  However, it is what Ms. Gallelli leaves out of her letter that is troubling. 

Ms. Gallelli announced in her letter that the court-appointed monitor of the Westchester County housing settlement has, in his September 8, 2014 report, taken a “fresh look” at the village’s zoning code and has “concluded” that our village’s policies reflect our commitment to “inclusion.” 

What Ms. Gallelli failed to explain was that the monitor’s September 8, 2014 report discussed only the monitor’s more recent analysis of impediments to fair housing in Westchester, which was conducted using a legal standard known as the “Huntington” standard.  The monitor’s report named several Westchester communities whose zoning codes either perpetuated segregation or had a disparate impact on minorities.  Thankfully, our village was not on that list. 

But in stating that the monitor had taken a “fresh” look, Ms. Gallelli implied that this more recent report has somehow absolved Croton on Hudson of the monitor’s earlier conclusion, reached after applying a legal standard known as the “Berenson” standard, of having exclusionary zoning because of barriers erected in village code against affordable housing development.  Croton on Hudson’s shameful inclusion on the earlier “Berenson” list was a direct result of the current administration’s reckless redrafting of the Harmon rezoning law.
