CUOMO COVID-19 RESTAURANT RESTRICTIONS DEALT A SETBACK IN COURT THIS WEEK

ALBANY – Restaurants located in state-designated orange zones can resume offering indoor dining after Gov. Andrew Cuomo's targeted system of COVID-19 restrictions was dealt a setback in court this week.

Cuomo's office announced Thursday that any restaurant currently in an orange zone can now operate under the less-onerous yellow zone restrictions, which will allow diners to eat inside with no more than four people at a table.

The decision came a day after state Supreme Court Justice Henry Nowak issued a preliminary injunction allowing dozens of Erie County restaurants to follow the yellow-zone rules after the owners claimed they were being unfairly targeted by the state.

Lawyers in Cuomo's office interpreted Nowak's ruling to apply only to the restaurants that were included in the lawsuit. But the governor's office concluded it will apply the ruling uniformly across all the state's orange zones to avoid confusion. 

"We are reviewing the decision," Kumiki Gibson, counsel to the governor, said in a statement. "While that process is ongoing, to ensure uniformity and fairness, all restaurants operating in Orange Zones can now operate under rules governing Yellow Zones."
