FOR THOSE FOLLOWING--HULINKSY V. WESTCHESTER, COUNTY'S LAW VIOLATED FIRST AMENDMENT RIGHTS...

IN THE NEWS--Two pro-life advocates, Oksana Hulinsky and Regina Molinelli, challenged a 2022 law called the Reproductive Health Care Facilities Access Act. This law restricted activities like sidewalk counseling, handing out leaflets, or engaging in conversation near abortion clinics. It created a 100-foot buffer zone and prohibited approaching within eight feet of another person without consent — even for peaceful dialogue...A federal court ruled on August 12, 2025, that the county’s law violated the First Amendment rights of Hulinsky and Molinelli...The court upheld a March 2025 decision rejecting Westchester County’s attempt to dismiss the lawsuit....The law’s vague language — especially the ban on “interference” by “deceptive means or otherwise” — was found to be overly broad and unconstitutional.... The ruling emphasized that peaceful sidewalk counseling is protected speech on public sidewalks.
